Treaty

Blowin's picture
Blowin started the topic in Monday, 5 Jun 2017 at 7:53pm

Without dispute , the single most hurtful act in the short history of our nation has been the dispossession of the indigenous Australians from the sovereignty of their homeland.

The continued deterioration of the General standard of living of the original inhabitants of our country cannot be ignored or abrogated .

Aboriginal Australians are calling for a treaty. What that treaty may encompass , I can only speculate.

What would you as a fellow Australian , consider a fair and equitable result of any such treaty ?

As a native born Australian myself that knows no other homeland and - to maybe romanticise the point - as someone that was born to the cry of the currawong and the laughter of the kookaburra, how can I reconcile my desire to appease the needs of the descendants of the First Nations peoples without conceding the fact that I also , am nothing if not as Australian as anyone else ?

Where does satisfaction lie with a treaty ?

A sovereign state within our borders ? If so, where ?

Who would be willing to vacate their home for a political body representative of the First Nation ancestors ? A political body constituent of people's that are often times as European as Indigenous by blood . Who determines whether anyone is pure Australian enough to qualify for any possible racial segregation ?

What other possible outcomes could result from a treaty ?

Would such a treaty be relevant in this new age of globalisation and the recognition of race as analogous branches of the same tree ? Will the discounting of racialism in pursuit of unified humanity render any such race based division as puerile ?

Bastards all.
Earlier I let slip to Swellnetonians, that over existence we left then returned to this shore.
In that time precious little has changed as human life-cycle rekindles that bastard within.

Young Aussie braves scout horizon venturing far to god forsaken outpost like Earl's Court.
Aussie drinks,fights, gets patched up goes broke & sentenced to Oz outpost next flight out.

Down & out loser seen as junkie girlfriend's next meal ticket. Meet the parents plot unfolds.
Move back in send parents half crazy. Fully abused & penniless bundled up to Elder Mission.
Lawyer gets whiff... real estate agent takes half... new owners sign. Round we go again.

In no way am I comparing Elder Abuse to Elder abuse...only bastards don't need invitation. Stealing land from Aborigines was a crime so to the hierarchy of land sales that followed.

Invading blue-bloods were entitled to finest dairy paddocks & crop lands.
Whereas Germans & like were restricted to mangrove swampland .( By entrapment still are.)
All the money in the world couldn't buy you out of hardship. Such was abuse of power.

Each new race of people the more restrictions on residence and livelihood.
Many fled cities only to be further harassed in lesser marked towns.
The bastards were upping their game on all fronts and it never ends.

Today's bastards were mapped out from day one.
Rule 1: Don't trust these bastards to stamp Australia's Treaty.

Yep, great points bash, all true.

Perhaps to simplify and speed things up, it would be better for us to figure out what 'the bastards' could be trusted with. I can hear the groans of what a hard and exhausting task that is, to actually find something, but, if there's one thing that phil and liz did well, it was to exemplify, and instill a perhaps slave like work ethic into their loyal subjects. When they weren't busy with the corgis and the kids.

Those bloody kids! Perhaps 'instill' isn't the best term, as the royals didn't mind giving their subjects a firm hand. Or along the lines of good 'ol uncle blowie, a good crisp, reflex boot or two, or fifty for that matter, to get the bastards twitching, and ram the message home! As far as the kids go, the royals always wanted them to have normal lives so as to stay in touch with the riff raff. Phil played a big role, encouraging the little bastards to keep their castles clean, and take to their 'darkies' with regular crisp, and well polished boots too! Before he would add with a wink and wry chuckle, ala his mate tony, 'and keep your snakes in your trousers ya buggers!'

Full text of the Barunga Statement, 1988

We, the Indigenous owners and occupiers of Australia, call on the Australian Government and people to recognise our rights:

to self-determination and self-management, including the freedom to pursue our own economic, social, religious and cultural development;

to permanent control and enjoyment of our ancestral lands;

to compensation for the loss of use of our lands, there having been no extinction of original title;

to protection of and control of access to our sacred sites, sacred objects, artefacts, designs, knowledge and works of art;

to the return of the remains of our ancestors for burial in accordance with our traditions;

to respect for and promotion of our Aboriginal identity, including the cultural, linguistic, religious and historical aspects, and including the right to be educated in our own languages and in our own culture and history;

in accordance with the universal declaration of human rights, the international covenant on economic, social and cultural rights, the international covenant on civil and political rights, and the international convention on the elimination of all forms of racial discrimination, rights to life, liberty, security of person, food, clothing, housing, medical care, education and employment opportunities, necessary social services and other basic rights.

We call on the Commonwealth to pass laws providing:

A national elected Aboriginal and Islander organisation to oversee Aboriginal and Islander affairs;

A national system of land rights;

A police and justice system which recognises our customary laws and frees us from discrimination and any activity which may threaten our identity or security, interfere with our freedom of expression or association, or otherwise prevent our full enjoyment and exercise of universally recognised human rights and fundamental freedoms.

We call on the Australian Government to support Aborigines in the development of an international declaration of principles for indigenous rights, leading to an international covenant.

And we call on the Commonwealth Parliament to negotiate with us a Treaty recognising our prior ownership, continued occupation and sovereignty and affirming our human rights and freedom.

Maybe it's just me but I would've thought listening and reading, god forbid, maybe even trying to understand the people doing the talking and writing, y'know doing a bit of homework before chucking in my own 10 cents of ignorance, would be the way to go, huh?

Actually, how's this? I've tried it and it's almost beyond my comprehension. Still don't stop me trying but.

Since when in human history that we know about has it been relevant of a particular race of people occupying a piece of land for a significant period, on this planet. Further there is a flawed mistake to assume the indigenous peoples are just one, meaning that any so called 'solution' will not 'satisfy' all. We would of course prefer a single voice but understand why that is so difficult.

Then i read some articles against to balance the view ,http://www.theaustralian.com.au/business/legal-affairs/a-treaty-with-fir...

Personally i think it will probably happen, i reckon labor will use it at some stage to gain some political points like the sorry thing, but i think it will be so watered down that it will only be a token thing, Aboriginal people wont be happy and nothing will really change.

tonybarber nailed it ! When was the 1st invasion?
Australian aborigines and scholars agree of a race before theirs.
Ancient Aborigines interbred Saltwater people 50,000 odd year ago.
Were they in turn invaders?

Australia was expansive with 250 separate language nations before we stepped foot.
Tall'n' White or Short 'n' Hairy & all colours between. So! Spot the local?

We applaud modern multicultural Australia but speak 100 fewer languages and now count our provinces on two hands.

Any hint of expansion of mind,tribe or language is outlawed by public opinion.
One word outta place on global blackboard can end a race, kill off career or get one shot at.

Treaty can salvage diversity... if Treaty becomes world lore.
Governments should be nowhere near our treaty nor have any say in signing .

There's a lot of opinions flying around in here essentially arguing the same thing. I've said before that I'm 100% in favor of indigenous representation at every level of parliament. The issue with this that keeps flying around is what degree of aboriginality would be the cutoff to vote? This is relevant because the treaty suggests a constitutional body that can advise government. This means it must be voted on. Who gets to vote? Is there an electoral roll of aboriginals? Sounds a bit too SS police for my liking and that would take us back a hundred years. The libs would only hand it over to centrelink in their quest to benchmark benefits anyway. On the same note, anything less than an electoral roll is rife for exploitation so its a stalemate.

I read someone mention negotiating table earlier on. What negotiating position do the aboriginal people have? They have zero bargaining power. It's more like begging power. The government holds every card and likely won't relinquish ultimate control over anything. What could the aboriginal people concede in a negotiation? There's almost nothing they could relinquish as they've already lost everything over the past 2 centuries.

This whole thing sounds good in principle but in reality I can't see it becoming anything more than a circus because the mechanics of it are just too messy .

@ Talking turkey

Don dale?....maybe you are talking about my comments on Adam Goodes incident?

The discussion went to bloodline and identifying after comments from Stuck in darwin.

I think the thing to remember is (especially in regard to that Aboriginal identity link) is that Aboriginal people don't all have the same view on things, that link says things like "full blood" are racist terms, but if you watch that video above "Aboriginal or not" you will see clearly that Aboriginal people themselves use these terms and can't agree on what makes someone Aboriginal or where the line should be drawn.

Everyone commenting here on the Identity thing should sit down and watch that video it's really interesting, basically full blood Aboriginal in this vid share my views and make the exact same points i have here, while those of mixed race with some Aboriginal bloodline are coming from the more left leaning angle.

BTW. That link to the identifying thing is kind of funny/crazy it takes a short bit out of the vid i posted above of Dallas Scott talking, there is no way he would be happy about that being used in the way it is, everything i have seen of him taking and what i have read from him, is total opposite of his views. (which are pretty much the same as mine)

This identity / bloodline thing.

My lived experience working with and within Aboriginals communities for a 4 year period following the release of the Royal Commission into Aboriginal Deaths in Custody in 1991 but including regular contact and work with Aboriginals from communities from the Gulf country and remote desert regions of SA, WA and from around the Alice.

Remote country people and urban people from Redfern and from Fitzroy all spoke as one, identity wasn't an issue ..... except for that one (and only one) time this ink black warrior raised it in a room of 100 Aboriginals from around the country. To say the room erupted as one like a fucking volcano is understating the heat and anger in the room.

So I say anyone wondering about this identity thing should actually ask Aboriginals what they think rather than getting information off the web.

One thing about this topic we get to see all the racist. White people thinking the are so superior than the black fella by thinking they aren't capable to do their own thinking and bidding (We have to save those poor souls because the are not capable themselves).
What a load of crap. I aboriginal born today is no more indigenous than any other race born in this country. As far as taking their land get over it as it can't be changed.
Aboriginals tribes have been taking land off each other since they arrived let alone the brutal killings of one tribe over the other.
Should one tribe want compensation over the other after being forced out of the area they once occupied 10,000 years ago. Or do they want compensation for atrocities one tribe caused over another tribe.
People have been taking land off each other since man arrived on this planet.
By the way the "Dreamtime" is a white fella's made up term.

All those are areas with predominantly Aboriginal people, yes they generally have much more important issues to worry about in those communities.

Maybe next time ask them about how the feel about the new wave of people who "Identify" as Aboriginal because their great great grandmother was Aboriginal and then believe they can be the voice for Aboriginal people, when in reality they dont face any of the problems or issues Aboriginal people face.

Anyway I'm going to try not to comment anymore, my thoughts and points are all in that video i posted above, points told and discussed by true Aboriginal people.

More ifs, buts, whatever's. More Lies. Law is law. Terra Nullius. Unless its good o' uncle whitey's law.

http://treatyrepublic.net/content/terra-nullius-0

'According to the international law of Europe in the late 18th century, there were only three ways that Britain could take possession of another country:

• If the country was uninhabited, Britain could claim and settle that country. In this case, it could claim ownership of the land.

• If the country was already inhabited, Britain could ask for permission from the indigenous people to use some of their land. In this case, Britain could purchase land for its own use but it could not steal the land of the indigenous people.

'• If the country was inhabited, Britain could take over the country by invasion and conquest- in other words, defeat that country in war. However, even after winning a war, Britain would have to respect the rights of indigenous people.'

http://www.migrationheritage.nsw.gov.au/exhibition/objectsthroughtime/bo...

'The Proclamation of Governor Bourke implemented the doctrine of terra nullius upon which British settlement was based, reinforcing the notion that the land belonged to no one prior to the British Crown taking possession of it. Aboriginal people therefore could not sell or assign the land, nor could an individual person acquire it, other than through distribution by the Crown.'

Law was broken, no ifs, buts, whatever's. We are in possession of stolen property. The law, again, good 'ol uncle whitey's law, is clear on being in possession of stolen property.

'The offence

If you have received stolen property knowing that the item has been stolen – it’s an offence. No if, buts, or whatevers about it.'

http://www.findlaw.com.au/articles/5471/how-is-receiving-stolen-property...

'Although you will likely not be charged with a crime, if you unknowingly bought stolen goods, you will probably have to return them to the rightful owner. The thief (or thieves) will then owe you the purchase price in restitution.Aug 27, 2014'

http://blogs.findlaw.com/blotter/2014/08/can-you-get-arrested-for-buying...

That's good 'ol uncle whitey's law. But, it didn't take long for people who met good 'ol uncle whitey, to clearly see that good 'ol uncle whitey didn't give a fuck about the law or anyone, he'd fuck, and right royal ream whoever he liked. Its a foundation of good 'ol uncle whitey's. Has been for a long time.

So, despite legally not having a leg to stand on, despite legally having no say in the matter, good 'ol uncle whitey's kin are gonna figure out what Indigenous Australians can do. In, by law, indigenous Australian sovereign land. Good 'ol uncle whitey's kin are carryin' on a storm! And as far as they are concerned, ya can fuck the law, and they'll fuck and right royal ream anything they like too, in an evolved, advanced fashion.

Thank God Indigenous Australians are offering us a treaty. By law, we should all be long gone. All this discussion should be taking place back on the queen's lawns, and be more concerned with how the queen is going to compensate her cherished subjects. By law, what Indigenous Australians offer good 'ol uncle whitey's kin is entirely up to them. We either agree, negotiate well, or simply fuck off back with the corgis.

You would think that good 'ol uncle whitey's kin would want the Indigenous Australians to see that we have changed, and changed considerably. But, as we can see clearly, there are plenty of good 'o uncle whiteys still trying to fuck and ream 'em white. Still plenty of swillnuts that can't believe no one has come up with this oldy, but goody, of good 'ol uncle whitey's.

'"It doesn't matter how much milk you put in coffee it's still coffee"

Which well is not true at some point it just becomes coffee flavour milk.'

And still plenty that want the Indigenous Australians to get the message, that good 'ol uncle whitey is still calling the shots, and always fuckin' will. So fuck the law!

'Hey indo, that's a nice lookin' house, good pozzy too!'

'Gidday, good 'ol uncle blowie's the name, red mistin' is me game! Can't help but notice ya place here, so's I'm here to offer ya a treaty on it! Nice car too! I reckon I'll need it on... aye, fuck that, I'm not fuck'n prepared to concede that ya stinking, thievin cunts! Tell ya fuck'n 'small minded no- one cunt moll' to fuck orf too, before she sets me orf'! And who's this fuck'n lot!

Next, everyone noticed a red mist, (they'd noticed the smell of cow shit too) and good 'ol uncle blowie turned to face Loud Mouth in front of his cunting piece of shit friends and with every ounce of will ,energy and misdirected anger from every point of his life, drove his fist into that cunt's putrid face and punched him to the lawn.'

https://www.swellnet.com/forums/wax/12736

'Gidday officer, Nick is it, that fuckin' thievin vermin are back on me fuckin' lawn again, whinin and fuckin' whingin about the past! Yeh, bring tone and the boys down, and move the cunts on! Maybe we'll give 'em a right royal reamin' while we're at it! The nerve of the cunts!' Hey did ya hear this one! '"It doesn't matter how much milk you put in coffee it's still coffee. Which well is not true at some point it just becomes coffee flavour milk.' Farkin bewdy, party time, bring the farkin' bintangs! You wouldn't have a cow would ya?

Carry on movin' on! Good 'ol uncle whitey, the peacemaker! Heading out in to the galaxy! Marvelous stuff, super!

I've gotta stop tellin' the truth. They reckon slattsey's coming down to release a new book about health and fitness, and staying injury free! Well he was gonna, but his back's pretty fucked, has been for ages. Getting worse all the time. Not to mention his shoulders and knees. So I won't. It's a secret. Is that legal? The truth? They reckon chia seeds can be woven into beanies. You can build houses out of them too. Swillnuts make bullshittin' look so easy!

See ya andy, ya bright spark! Hey notice how two dogs is never around when... Faaaaaark, 'ang on, ang on, ang on a minute! Ya can't fool me ya tricky bugga! You're even brighter than I thought! A real bright spark! Carry on!

AndyM, you obviously don't subscribe to Langtons thoughts. She simply wants to provide an economic freedom, prosperity and future in today's world for the indigenous. She is right, of course and so is the government wanting to develop the region and provide jobs. Purely because 'coal' is involved. Think about it, can India buy coal elsewhere. If so, why not. Is India a signatory to the Paris Agreement. Is that a key issue.
The livelihood and well being of the idigenous is what sees at the key point. That is not turning to the 'dark side' on any measure.

And Barberino, do you realise that the local crew around the proposed Adani mine are against the proposal?
Does their livelihood and well being count?

I'm sorry mate but at best, Langton appears to be "poorly informed" as do you.
